By accessing or using CremyX, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the platform.

We may update these Terms from time to time. Continued use of CremyX after changes constitutes acceptance of the revised terms.

By using CremyX, you acknowledge and agree to our data practices as described in our Privacy Policy, including the use of aggregated and anonymized data to improve our AI services.

You must provide accurate and complete information when creating an account.

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

You must be at least 16 years old to create an account and use CremyX.

You agree to notify us immediately of any unauthorized use of your account.

CremyX operates on a credit-based system. Credits are consumed when you use AI-powered features such as content generation, image creation, brand analysis, and video generation.

Free accounts receive a limited number of credits. Paid plans provide monthly credit allocations as described on our Pricing page.

Refund Policy: Paid plans include a 14-day money-back guarantee from the date of your first subscription purchase. To request a refund within this period, contact us at support@cremyx.com.

Credits are non-transferable and non-refundable. Unused monthly credits do not roll over unless specified by your plan.

We reserve the right to adjust credit costs for specific features with reasonable notice.

You own the content you create. All text, images, videos, and marketing plans generated through CremyX using your brand data belong to you.

You grant CremyX a limited license to process your inputs (brand data, prompts, uploaded assets) solely for the purpose of generating content on your behalf.

CremyX does not claim ownership over your generated content and will not use it for purposes other than delivering the service to you.

You are responsible for ensuring your use of generated content complies with applicable laws, including intellectual property and advertising regulations.

You acknowledge that by using CremyX, your brand data and usage patterns may be used to improve our AI models and personalize your experience. Aggregated, anonymized insights derived from platform usage contribute to enhancing service quality for all users.

You agree not to use CremyX to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or discriminatory.

• Create misleading or deceptive marketing materials that violate advertising standards.

• Attempt to reverse-engineer, decompile, or extract the underlying AI models or algorithms.

• Circumvent credit limits, abuse free tiers, or create multiple accounts to exploit the system.

• Upload content that infringes on third-party intellectual property rights.

• Use automated scripts or bots to access the platform without authorization.

CremyX relies on trusted third-party service providers for AI processing, cloud hosting, authentication, and other infrastructure services to deliver the platform.

We do not disclose the specific identities of our technology partners. This information is considered proprietary.

CremyX is not responsible for any interruptions, delays, or failures caused by third-party service providers.

You must have the legal right to any URLs, content, images, or other materials you submit to CremyX for analysis or processing. You are solely responsible for ensuring your submissions do not violate third-party intellectual property or privacy rights.

The CremyX platform, including its design, code, features, branding, and documentation, is owned by CremyX and protected by intellectual property laws.

You may not copy, modify, distribute, or create derivative works based on the CremyX platform without written permission.

Third-party trademarks and logos analyzed through brand import remain the property of their respective owners.

We strive for high availability but do not guarantee uninterrupted access. The platform may experience downtime for maintenance, updates, or unforeseen issues.

AI-generated content is provided "as is." While we work to ensure quality, we cannot guarantee that all generated content will be accurate, complete, or suitable for your specific use case.

You acknowledge that AI technology has inherent limitations and should review all generated content before publishing or distributing it.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

CremyX specifically disclaims all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that AI-generated content will be error-free, accurate, or suitable for any particular purpose. You are solely responsible for reviewing and verifying all generated content before use.

No advice or information, whether oral or written, obtained from CremyX shall create any warranty not expressly stated in these Terms.

To the maximum extent permitted by law, CremyX shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.

Our total liability for any claims related to the service shall not exceed the amount you paid to CremyX in the 12 months preceding the claim.

We are not responsible for any losses resulting from the use or publication of AI-generated content.

You agree to indemnify, defend, and hold harmless CremyX, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in any way connected with:

• Your use of AI-generated content, including any claims of intellectual property infringement by third parties.

• Your violation of these Terms or any applicable law or regulation.

• Your submission of content, URLs, or materials that infringe on third-party rights.

• Any misuse of the platform or unauthorized access to your account.

You may delete your account at any time through your account settings. Upon deletion, your data will be permanently removed within 30 days.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in abusive behavior, or pose a security risk.

Upon termination, your right to use the platform ceases immediately. Any unused credits will not be refunded.

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of CremyX shall first be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in the State of Delaware.

Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Force Majeure: CremyX shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, power failures, internet or telecommunications failures, or third-party service outages.

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and CremyX regarding your use of the platform and supersede all prior agreements and understandings.
